Aviorart (“Aviorart,” “we,” “us,” or “our”) operates this online store and related services. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our website, create an account, place or inquire about an order, submit materials for custom artwork, communicate with us, or otherwise use our services (collectively, the “Services”).

By using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree, please do not provide personal information or use the Services.

1. Personal Information We Collect

Depending on how you interact with us, we may collect the following categories of information:

Contact and account information

Your name, email address, telephone number, billing and shipping addresses, account credentials, language, country or region, and communication preferences.

Order and commercial information

Products viewed or purchased, order numbers, transaction history, product preferences, requested modifications, preview approvals, returns, refunds, customer support records, and other details needed to create and deliver your artwork.

Payment information

Payment method, billing details, transaction status, and limited payment-related information provided by Shopify and our payment processors. Full payment-card numbers are generally processed by our payment providers and are not stored by Aviorart.

Custom-artwork content

Photos, images, names, text, creative concepts, color preferences, measurements, and other materials or instructions you choose to submit for customized or commissioned artwork. A submitted image may incidentally reveal personal characteristics about a person. We use these materials to evaluate, create, revise, and support your order; we do not use facial images for biometric identification.

Communications and user content

Emails, messages, telephone inquiries, feedback, reviews, survey responses, and any other content you send to us or post through the Services.

Device and usage information

IP address, browser and device type, operating system, cookie identifiers, approximate location derived from IP address, referring pages, pages or products viewed, search activity, shopping-cart activity, checkout interactions, and information about how you use the Services.

Fraud-prevention and compliance information

Information used to verify transactions, prevent fraud and abuse, enforce our policies, resolve disputes, and comply with legal obligations.

We ask that you provide only information reasonably necessary for your request or order. If you provide personal information about another person, you confirm that you have permission to provide it for the relevant purpose.

2. How We Collect Information

- directly from you, including at checkout, through an account, contact form, email, telephone call, custom-art request, review, or return request;
- automatically, through cookies, pixels, tags, local storage, server logs, Shopify technology, and similar tools when you use the Services;
- from service providers and business partners, such as Shopify, payment processors, fraud-prevention providers, analytics and advertising partners, social platforms, and delivery carriers; and
- from other lawful sources, for example when someone purchases artwork for you, refers you to us, or communicates with us on your behalf.

3. How We Use Personal Information

We may use personal information to:

- provide, operate, personalize, maintain, and improve the Services;
- accept payment, verify, create, modify, preview, fulfill, ship, and support orders;
- communicate about order status, preview approval, delivery, returns, refunds, and customer-service requests;
- connect customers with artists and production personnel who need information to complete an order;
- create and revise customized artwork using customer-provided materials and instructions;
- establish and manage customer accounts;
- detect, investigate, and prevent fraud, security incidents, prohibited conduct, and misuse;
- perform analytics, understand store performance, and improve our products, website, and customer experience;
- send marketing communications where permitted, and measure or personalize advertising subject to applicable consent and opt-out rights;
- maintain business, accounting, tax, warranty, dispute, and compliance records;
- enforce our Terms of Service and other policies; and
- comply with law, legal process, and lawful requests, and protect the rights, safety, and property of customers, Aviorart, Shopify, our providers, and others.

Where applicable law requires a legal basis, we process information as needed to perform a contract with you, comply with law, pursue legitimate business interests that are not overridden by your rights, protect vital interests, or act with your consent.

4. Shopify and Other Service Providers

Our store is hosted by Shopify. Shopify collects and processes information about your access to and use of the Services to provide its commerce platform, checkout, security, analytics, personalization, and other services to us and to you. Information submitted through our store may therefore be transmitted to Shopify and its service providers in countries other than your own.

Their handling of information is governed by their own terms and privacy notices when they act independently from us.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this policy:

- Shopify and commerce providers that host and operate our store, accounts, checkout, and related functionality;
- payment and fraud-prevention providers that authorize transactions, manage chargebacks, and protect the Services;
- artists and production partners who need relevant order details, specifications, or submitted reference materials to create or revise your artwork;
- shipping and logistics providers, including DHL, FedEx, UPS, customs brokers, insurers, and local delivery partners;
- technology and professional service providers, including hosting, email, customer-support, security, analytics, accounting, legal, and compliance providers;
- advertising, social-media, and analytics partners, subject to applicable consent and opt-out requirements;
- government authorities, courts, regulators, or other parties when disclosure is required or permitted by law, needed to protect rights and safety, or necessary to investigate fraud or unlawful activity;
- parties to a business transaction, such as a merger, financing, reorganization, sale of assets, or transfer of the business, subject to appropriate safeguards; and
- other parties at your direction or with your consent.

We do not sell personal information in exchange for money. However, the use of certain advertising, analytics, pixels, cookies, or Shopify features may be considered “selling,” “sharing,” or “targeted advertising” under some U.S. state privacy laws even when no money changes hands. Where those laws apply, you may opt out as described below.

6. Cookies, Analytics, and Advertising

We and our partners, including Shopify, use cookies and similar technologies to:

- operate checkout, accounts, shopping carts, security, and other essential functions;
- remember preferences and personalize the Services;

Where available, use the Your Privacy Choices or data-sharing opt-out link in our website footer to opt out of processing that may be considered a sale, sharing, or targeted advertising. In jurisdictions where we are required to recognize it, we also process an enabled Global Privacy Control (GPC) signal as an opt-out request for the browser or device sending the signal.

You can unsubscribe from promotional email by using the unsubscribe link in the message. Even after opting out of marketing, we may still send non-promotional communications about orders, transactions, security, policy changes, or customer support.

7. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to complete and support orders, maintain business and tax records, resolve disputes, prevent fraud, enforce agreements, and comply with law.

Retention periods vary based on the type and sensitivity of information, the reason it was collected, legal or contractual requirements, and whether it is needed to establish or defend legal claims. When information is no longer needed, we will delete, anonymize, or securely isolate it where reasonably practicable.

Custom reference images and instructions are kept only as long as reasonably needed to create and support the commissioned artwork, preserve necessary transaction records, resolve a dispute, or meet legal obligations. You may request deletion as described below, although we may retain limited records where permitted or required by law.

8. International Data Transfers

Aviorart serves customers internationally and works with Shopify, artists, carriers, and service providers in multiple countries. Your information may be transferred to, stored in, or processed in Hong Kong, the United States, Canada, and other countries where our providers or production partners operate. Privacy laws in those locations may differ from the laws where you live.

Where required, we use contractual or other recognized safeguards for international transfers. By submitting custom materials, you understand that relevant materials and instructions may be provided to the artist or production personnel assigned to your order, wherever they are located.

9. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No website, transmission, or storage system can be guaranteed completely secure, and we cannot promise absolute security. Please use a unique password, protect your account credentials, and notify us if you suspect unauthorized account activity.

10. Your Privacy Rights

Depending on where you live and subject to legal exceptions, you may have the right to:

- request access to or a copy of personal information we hold about you;
- request correction of inaccurate information;
- request deletion of personal information;
- receive certain information in a portable format;
- object to or restrict certain processing;
- withdraw consent for future processing where processing is based on consent;
- opt out of sale, sharing, targeted advertising, or certain profiling;
- limit certain uses of sensitive personal information, where applicable;
- appeal our decision on a privacy request, where applicable; and
- receive equal service and pricing without unlawful discrimination for exercising privacy rights.

We may ask for information reasonably necessary to verify your identity and authority. An authorized agent may submit a request where permitted by law, but we may request proof of authorization and identity verification.

If we deny a request, you may appeal by replying to our decision with the subject line “Privacy Appeal.” We will respond within the period required by applicable law.

For Australian individuals, where the Australian Privacy Act applies, you may also contact us with a privacy complaint. We will investigate and respond within a reasonable period. If you remain dissatisfied, you may have the right to contact the Office of the Australian Information Commissioner.

11. Children’s Privacy

The Services are intended for a general audience and are not directed to children under 16. We do not knowingly collect personal information from children under 16 without legally valid permission. If you believe a child has provided personal information to us, contact support@aviorart.com so we can review and delete it where appropriate.

12. Third-Party Websites

The Services may link to websites, apps, or services operated by third parties. We do not control their privacy or security practices. Please review their privacy notices before providing information to them.
